1. INTRODUCTION

1.1. These Terms and Conditions regulate the sale, including registration, of Oak products, through the website www.oak.com.pt
1.2. These general conditions of sale are agreed between Oak, headquartered at Estrada da Barroqueira, 41 - 7400-115 - Ponte de Sor and contact geral@oak.com.pt, telephone 910516864.
1.3. For the purposes of these Terms and Conditions, this means:
a) "OAK" - Products sold on the website www.oak.com.pt;
b) "User" - Any natural person, non-merchant, who places an order through the website www.oak.com.pt;
1.4. The use of the website www.oak.com.pt and the purchase of Oak products presupposes knowledge, understanding and acceptance of these Terms and Conditions by the User.

2. REGISTRATION ON THE WEBSITE

2.1. To place an order, the User may register in advance by filling in the fields on the form on the website www.oak.com.pt.
2.2. From the moment you access your personal account, the User is subject to these Terms and Conditions.

3. OAK PRODUCTS

3.1. The website www.oak.com.pt is aimed at all users who wish to purchase Oak brand products.

3.3. Oak reserves the right to modify, at any time, the information, product offerings, prices, promotions and commercial conditions presented on the website www.oak.com.pt

4. PLACING ORDERS ON THE WEBSITE

4.1. To order at www.oak.com.pt, the User must have an email account and their browser must be configured to accept cookies and pop-ups, which will allow the user to enjoy all the store's navigation conditions. Oak online.

4.1.1. The User may purchase products online, for which they must:

a) Find the product(s) you want to purchase;

b) Add the selected product(s) to the "Shopping Cart";

c) Register the User's personal data, which will be integrated into Hyndia's database under the terms set out in the Privacy Policy, which include the "Delivery Address", "Billing Address", "Payment Method" , telephone number and tax identification number (TIN);

d) Review your order and confirm the request;

4.2. The User will receive an order confirmation email with details regarding the payment method they selected.

4.3. Your order will be delivered by the logistics operator to the delivery address indicated in the purchase process and with the corresponding detailed invoice.

4.4. By submitting the order form, the User accepts the Terms and Conditions of purchase described at www.oak.com.pt, as well as the Privacy Policy.

4.5. Oak reserves the right not to accept and cancel orders already confirmed in the following situations:

a) The product is not available;

b) Payment is not made using any of the payment options available on the website;

c) Payment is not confirmed;

d) The billing information is not correct or verifiable;

e) There is an error in the price quote;

f) It is not possible to deliver to the address provided by the User.

5. PRICES

5.1. Product prices displayed on the website include Added Value (VAT). The total VAT payable by the User will be indicated on the invoice sent to the User.

5.2. Prices are all quoted in euros (€). Please note that changing the country of delivery may have an influence on prices due to different transport costs. Customs costs relating to the country of delivery of the order will be borne by the customer.

5.3. The prices of products presented on the website are subject to change. Oak reserves the right to change prices without prior notice. The prices displayed at the time of purchase are the prices applied to that purchase.

5.4. If there is an error in the price of the ordered products, Oak or the User may, until the order is shipped, cancel the order.

5.5. The total price specified at checkout includes taxes from the country of origin (Portugal) and shipping costs.

5.6. The User must pay only the amount specified in the order confirmation.

6. PAYMENT METHODS

6.1 Oak offers the following payment methods:

Collection and payment at the premises


6.2. Oak does not accept any other payment method than those mentioned in the previous point. The User must not attempt to pay by any means other than the specified payment methods. If you do so, we cannot be held responsible for lost payment or any other damages that may arise.

7. SHIPPING COSTS

7.1. The value of shipping costs is indicated in the shopping cart before final validation of the order, in the case of deliveries to Mainland Portugal, Spain, Madeira, Azores and Europe.

8. DELIVERY

8.1. Oak will ship the product(s) ordered by the User, from Monday to Friday, from 9am to 3pm, with the exception of holidays, and on the days and times used by the logistics company, for delivery address indicated by the User.

8.2. Our delivery service does not include a scheduling option, so the order will be delivered without prior contact from the carrier, and it is necessary to ensure that someone is at the delivery address.

8.3. Delivery times in Portugal vary between 2 and 4 working days depending on the item ordered. Oak's ability to respond within these deadlines varies depending on stock availability, as well as during promotions, sales and Christmas periods.

8.4. Oak will inform the User of the unavailability of the product(s) ordered, as well as reimburse the amount paid, within a maximum period of 15 (fifteen) days from becoming aware of the unavailability.

8.5. If the carrier is unavailable to deliver the products on the indicated date, the User will be contacted to provide another delivery date.

8.6. Upon delivery, the User must inspect the packaging to check for any damage. If you find that the products are damaged, the User must not accept delivery of the order, which will be returned. The User must report the situation, if possible documented with photographs, via email geral@oak.com.pt and if they agree, Oak will resend the order, at no cost to the User. If the User wishes to cancel the order, the entire amount paid will be refunded.

8.7. If you do not receive your order within a maximum period of 30 (thirty) days from the date of payment for the order, please send an email to geral@oak.com.pt informing us of what happened. After this period, Oak cannot be held responsible for the loss of the order.

8.8. Delivery is considered to have been made with the signature on the delivery receipt at the agreed address.

9. RIGHT TO FREE RESOLUTION

9.1. The User may terminate their contract up to 14 (fourteen) days after receiving the order, provided that:

a) The product(s) have not been used;

b) The product(s) maintain their original characteristics and labels intact;

c) The product(s) are complete. All material accompanying orders must be returned.

9.2. The User can exercise their right to free resolution by sending an email to geral@oak.com.pt.

9.3. The costs of returning the order when exercising the right of free resolution are borne by the customer.

9.4. Once the returned product has been received, Oak will analyze and confirm the conservation status of the order and, where applicable, will refund within a maximum period of 15 (fifteen) days the amounts paid by the User contained in the order, through the same means used to pay for the order. order.

9.5. If the returned items show signs of use, Oak reserves the right not to accept the return and refuse to refund them.

9.6. The User must note that, if the return was made for reasons other than the justified existence of a defect or non-conformity of the ordered products, Oak will not reimburse the shipping costs. Therefore, Oak will not reimburse the costs related to postage initially borne by the customer for the respective order.

9.7. Please note that these conditions are only valid for orders placed in Portugal. If your order was placed outside Portugal, please contact us via email geral@oak.com.pt

10. CANCELLATIONS AND RETURNS

10.1. The User may cancel their order, as long as they request it via email geral@oak.com.pt before it is shipped.

10.2. If the order has been received before shipping, we will refund the amounts paid by the User included in the order, through the same means used to pay for the order, within a maximum period of 15 (fifteen) days.

10.3. If the request has been received after sending, the rules set out in the previous chapter will apply.

10.4. In the case of an exchange, the User will have to bear all costs related to the new shipment.

10.5. If the ordered product is defective or otherwise non-conforming, the User may choose to:

a) replace the product;

b) terminate the contract.

10.6. As soon as the User notices a defect or other non-conformity in the product, they must notify us via email geral@oak.com.pt, sending supporting photographs.

10.7. As soon as we receive your email, we will contact you to resolve the problem consensually.

11. QUALITY

Oak does not sell second-hand products, which are defective or of lower quality than those currently available on the market.
Oak will make every effort to ensure that the colors of the products that appear on the website www.oak.com.pt are as accurate and real as possible. However, as computer monitors vary, we cannot guarantee that your monitor is showing accurate colors.

12. COMPLAINTS

In view of the objective of continuous improvement of the services provided, Oak will seek to respond to and resolve complaints presented by the User within 5 (five) business days, via email geral@oak.com.pt.

13. WARRANTY AND AFTER SALES SERVICES

Oak products benefit from the guarantee of conformity provided for in the legislation applicable to the sale of consumer goods.

14. EXCLUSION AND LIMITATION OF LIABILITY

Oak does not guarantee the uninterrupted operation of the website www.oak.com.pt, or any of its features, and it may be suspended to carry out maintenance, repair or updates.
Oak will also not assume any responsibility for any damages arising, directly or indirectly, from situations of force majeure that prevent Oak, in any way, from fulfilling its obligations, namely strikes, network failures electricity, telecommunications services or any other services, fires, floods, impossibility of obtaining products, materials or services, breakdowns, delays by suppliers or transporters and changes in legislation or administrative regulations.
Oak is not responsible for any abusive use of the User's access data to the website by third parties, as they are personal and non-transferable.

15. MODIFICATION OF TERMS AND CONDITIONS

Oak reserves the right to change these Terms and Conditions at any time, considering the changes made and users notified through publication on the website www.oak.com.pt of the modified Terms and Conditions.

16. PROCESSING OF PERSONAL DATA
